Arrested for Driving Under the Influence?
An arrest for driving under the influence of alcohol or drugs can be devastating without a competent attorney to
evaluate the case and let you know if you actually have a legal defense or not. Unfortunately, most criminal defense
attorneys will charge from $3,000.00 to over $10,000.00 to take your case then tell you to plead guilty because the case
will lose at trial.
That is not the way I operate! I will accept your misdemeanor DUI case for $750.00. For that fee, I will make all the
appearances in court. As long as your case is a misdemeanor, you do not need to even appear in court or miss any work to
have your case handled. I will get the police reports, review all the evidence, check to see that any chemical tests are
accurate, evaluate your case for all the legal elements, and bring a motion to suppress evidence if there is a legal basis
for doing a motion to suppress evidence.
If a motion to suppress evidence is granted, the case will most likely be dismissed. If there is no basis for a motion to
suppress or the motion is denied, we will then sit down and discuss the likelihood of winning your case at trial. If after
considering all your options you decide to plead guilty or no contest, I can appear for you and enter a plea without you
ever going to court. If your case is dismissed or you enter a plea prior to trial confirmation (the last appearance before
the trial actually begins), you will owe no more attorney fees.
If after considering all your options, you and I agree to go to trial, I will quote you a fee based on the estimated length of
trial. As with other cases, I quote fees at approximately $2,000.00 per day of trial. A one day trial will cost an additional
$2,000.00 (most DUI cases are done in one or two court days), a two day trial will cost an additional $4,000.00, etc.
Other costs that may be necessary are expert witness fees and investigator fees. These usually run less than an additional
$500.00.
The bottom line is that if we take a case all the way to trial, you are looking at between $3,000.00 to over
$10,000.00 in attorney fees and costs. The difference is that it does not costs you the entire fee to find out if you have
a case that can be won--for $750.00 you can have an expert opinion on the legality of the case, and, if you decide to resolve
your case by entering a plea, no additional attorney fees are necessary.
